Terms and Conditions of Sale

1. Purpose

Bike It, a single-member limited liability company (SARL à associé unique) with share capital of €2,500, registered with the Melun Trade and Companies Register under SIRET no. 104 766 373 00013, provides an electrically assisted bicycle (e-bike) rental service with delivery directly at Fontainebleau-Avon station (77), for half-day or full-day durations, including additional options (food, sunset, accessories).

These Terms and Conditions of Sale (T&Cs) govern any contractual relationship between Bike It and any individual customer making a booking online.

2. Right of withdrawal

In accordance with Article L.221-28 12° of the French Consumer Code, the 14-day right of withdrawal provided for distance contracts does not apply to leisure services whose date and time of performance are set at the time of booking.

By booking a rental for a specific date and time slot, the customer expressly acknowledges that this service falls within this legal exception. The applicable cancellation policy is exclusively the one defined in Article 11 of these T&Cs.

3. Booking

Booking is made exclusively online via the Bike It website. It is considered confirmed only after:

  • Full payment of the order;
  • Receipt of a confirmation email from Bike It.

4. Pricing

Prices are shown in euros, all taxes included.

Packages:

  • Morning (9am-1pm): €29
  • Afternoon (2pm-6pm): €29
  • Full day (9am-6pm): €49

Available options:

Bike It reserves the right to change its prices at any time, with no impact on bookings already confirmed and paid.

5. Delivery

Bikes are handed over to the customer at Fontainebleau-Avon station, at the time agreed at booking. The customer must arrive at the stated time.

Any delay of more than 30 minutes, without prior contact with Bike It, may result in cancellation of the booking without refund. In the event of an unforeseen circumstance, the customer is invited to contact Bike It as soon as possible.

If Bike It is unable to provide the booked bike (unforeseen technical unavailability, force majeure), Bike It undertakes to inform the customer as soon as possible and to offer, at the customer's choice:

  • a postponement of the booking to a later date at no extra cost;
  • a full refund of the amounts paid.

6. Rental duration

The rental corresponds strictly to the booked time slot. Any exceeding of the agreed duration may result in:

  • an additional charge calculated on the basis of the daily rate in force at the time of booking, per 30-minute period started;
  • an impact on the next booking of the same bike.

7. Condition report and security deposit (card hold)

Condition report. A joint condition report is carried out by Bike It at handover and return of each bike. The customer acknowledges the condition of the equipment handed over by signing the handover form. Any damage not reported at handover and found at return is presumed to have occurred during the rental period and may be charged to the renting customer.

Security deposit by card hold. As a guarantee, Bike It places a temporary hold of €500 per rented bike on the customer's bank card (for example €1,500 for three bikes). This amount is not charged: it is only reserved (held) on the customer's account and remains unavailable for the duration of the rental.

Timing of the hold. If the rental takes place within three days of the booking, the hold is placed immediately, at the time of payment. If the rental is further away, the hold is placed one to three days before the rental date. The rental fee itself is charged as soon as the booking is made, independently of the hold.

Pre-booking and suspension. As long as the hold has not been successfully placed, the booking is a pre-booking. If, at the time the hold is placed, the funds are not available on the customer's card, the booking is suspended: Bike It informs the customer, who is given a period of time to resolve the issue (retry with another card). Failing resolution, Bike It reserves the right to cancel the booking.

Consent and capture. By entering their card details and confirming their order, the customer expressly consents to the security hold and authorizes Bike It to capture all or part of the held amount in the event of damage, loss or non-return of the equipment, without further authorization. This consent, specific to the card hold, cannot be unilaterally revoked by the customer once the hold has been placed.

Release and capture. In the absence of damage found jointly, the deposit is released upon return of the bike and after verification of its condition; the funds then become available again on the customer's account (release may take a few days depending on the bank). In the event of damage found jointly, the amount actually captured is limited to the real cost of repairing or replacing the damaged equipment, up to the bike's replacement value. The customer is informed of the amount withheld before any capture.

Limitation. The card hold guarantees the availability of funds at the moment it is placed, but does not guarantee the customer's solvency at a later date. Bike It cannot be held liable for an inability to capture funds due to insufficient funds on the customer's account beyond the hold period.

8. Customer liability

The customer is fully responsible for the bike throughout the rental period. In the event of theft, breakage or damage, the repair or replacement costs found jointly may be charged and deducted from the guarantee referred to in Article 7. If the costs exceed the amount of the guarantee, the difference will be invoiced separately.

The customer undertakes to:

  • lock the bike with the provided lock when not in use;
  • not leave the bike unattended in a public place;
  • use the bike in accordance with its intended purpose and the Highway Code.

9. Conditions of use

Fitness and compliance with the Highway Code. The customer declares being physically fit to ride a bike and undertakes to comply with the Highway Code in force. Bike It accepts no liability in the event of misuse or non-compliance with the Highway Code.

Age requirements. Bike rental is reserved for adults (18 years and over). Minors may only use a bike under the direct responsibility and constant supervision of a legal guardian.

The customer is responsible for choosing the bike size (S, M or L) at the time of booking. Bike It cannot be held liable for any unsuitability resulting from a size choice made by the customer.

10. Breakdown assistance

A breakdown assistance option is offered at booking (€14.90). In the event of a technical problem, breakdown or difficulty preventing normal use of the bike, the customer may contact Bike It to receive on-site assistance.

Bike It undertakes to make every effort to intervene as soon as possible. As a guide, the response time is generally between 30 and 90 minutes depending on the customer's location, traffic conditions and current activity. This time is provided for information only and does not constitute a contractual commitment.

Assistance is valid only during the rental period set at booking.

11. Cancellation and refund

Any cancellation made more than 24 hours before the start of the rental gives rise to a full refund of the amounts paid.

After this deadline, no refund is due. On a purely commercial basis and subject to availability, Bike It may offer a postponement or a credit note - this option does not constitute a contractual obligation and cannot be invoked as of right.

Cancellation procedure. Any cancellation request must be sent by email to contact.bikeit@gmail.com, stating the booking number. The date and time the email is received shall prevail.

12. No-show

In the event of a no-show by the customer at the agreed time and without prior contact: no refund will be made and the booking will be considered consumed.

13. Weather conditions

Weather conditions do not constitute grounds for automatic cancellation or refund. The customer remains free to cancel within the deadlines set in Article 11.

14. Insurance

Bike It is covered by Professional Civil Liability insurance covering bodily and material damage caused to third parties in the course of the bike rental activity.

This insurance does not cover:

  • damage suffered directly by the customer while using the bike;
  • damage caused by the customer to the rented equipment;
  • accidents involving the customer as a third party in respect of themselves.

Bike It strongly recommends that every customer check that their personal civil liability insurance (generally included in their home multi-risk policy) covers the use of rented bikes. In the absence of such coverage, the customer remains personally responsible for any damage they may cause to third parties.

15. Personal data

The data collected at booking is used solely for the performance of the service. For more information, please refer to the Privacy Policy available on the Bike It website.

16. Consumer mediation

In accordance with Articles L.616-1 and R.616-1 of the French Consumer Code, Bike It has joined an approved consumer mediation service. Any consumer may refer a matter to this mediator free of charge in the event of an unresolved dispute, within one year of the first written complaint sent to Bike It.

17. Applicable law and disputes

These T&Cs are governed by French law. In the event of a dispute, an amicable solution will be sought as a priority, in particular through mediation (Article 16). Failing an amicable resolution, the competent courts of the jurisdiction of Melun (Seine-et-Marne) shall be seized.
